EZXP — Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you and EZXP governing your access to and use of ezxp.gg and any related services, apps, and features (the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

We may update these Terms at any time in our sole discretion. Material changes will be posted on the Service and/or notified to you, and your continued use after changes take effect means you accept the updated Terms.

2. Eligibility and age

To use the Service you must:

• Be at least 16 years old;
• Be old enough to form a binding contract in your jurisdiction, or have the verifiable consent of a parent or legal guardian who agrees to these Terms on your behalf and accepts responsibility for your use;
• Not be located in, or a resident of, any country or region we do not serve or that applicable law prohibits.

No children under 13. The Service is not directed to and may not be used by anyone under 13. We do not knowingly collect personal information from children under 13; if we learn we have, we will delete it.

Minors (16–17). If you are 16 or 17, you represent that your parent or legal guardian has reviewed and agreed to these Terms. Cash payouts (including PayPal and cryptocurrency) require you to be 18 or older. Users aged 16–17 may redeem rewards only in the forms we make available to minors (such as gift cards), and certain offers, surveys, and features are restricted to users 18+.

Age verification. We may request proof of age or identity at any time, and may suspend, restrict, or close any account pending or following such verification.

By using the Service, you represent and warrant that you meet all eligibility requirements. If you do not, you must not use the Service.

3. Accounts

• One account per person and per household. Creating or operating multiple accounts is prohibited and is grounds for forfeiture of rewards and termination.
• You must provide accurate, current information and keep it updated. Registering with false information is a violation of these Terms.
• You are responsible for all activity under your account and for keeping your credentials secure. Notify us immediately of any unauthorized use.
• Accounts are personal and non-commercial. You may not sell, transfer, or share your account.

4. How the Service works

EZXP is a rewards platform. You can complete offers, quests, surveys, and other activities ("Offers") — many provided by third-party advertisers and offer-wall partners — and earn in-platform points ("Coins") and experience ("XP"). Coins and other rewards may be delivered through gamified mechanics, including loot containers we call "Caches." Earned Coins may be redeemed for available rewards subject to these Terms.

We do not guarantee that any particular Offer, reward, payout method, value, or feature will be available, accurate, or continue to be offered, and we may add, change, or remove any of them at any time.

5. Coins, Caches, and rewards

• Coins and Caches are earned, never purchased. EZXP does not sell Coins, Caches, cache openings, or random outcomes for money. There is no mechanism to pay money for a chance at a reward. The Service is an engagement-and-rewards platform, not a gambling service.
• No cash value; not your property. Coins, XP, Caches, levels, and similar items have no independent monetary value, are a limited license to use a feature of the Service, and are not your property. They cannot be transferred, sold, or exchanged except as we expressly allow, and they are forfeited on account closure.
• Revocable and adjustable. We may modify, expire, reduce, or revoke Coins, rewards, conversion rates, reward catalogs, and redemption thresholds at any time, including to correct errors or address suspected fraud or abuse.
• Errors. If Coins or rewards are credited in error (including due to a third-party reporting mistake, duplicate, or technical fault), we may reverse or adjust them, even after redemption.

6. Earning and third-party Offers

• Many Offers are operated by third parties (advertisers, offer-wall networks, survey providers). Your participation in a third-party Offer may also be subject to that third party's terms and privacy practices, which are beyond our control.
• We generally credit Coins only after the relevant partner confirms your completion to us. Completions that are not reported, not confirmed, reversed, charged back, or flagged as invalid or fraudulent will not be credited, or will be deducted if already credited.
• We are not responsible for third parties' acts, omissions, tracking failures, or non-payment, and we may decline to credit any completion at our discretion where it is unverified or suspicious.

7. Redemption and payouts

• Redemptions and payouts are subject to minimum thresholds, available methods, and verification, all of which we may change.
• Holds and verification. We may impose holding periods before any payout and may require identity verification (KYC), age verification, or other checks before processing a redemption, particularly for larger amounts or where activity appears irregular.
• Discretion to withhold or forfeit. We may delay, withhold, reverse, reduce, or cancel any reward or payout, and may freeze or forfeit account balances, where we reasonably suspect fraud, multiple accounts, abuse, violation of these Terms, or where required to verify eligibility or comply with law. We are not obligated to pay out Coins or rewards earned through, or associated with, prohibited conduct.
• Cash payouts are 18+. Cash-equivalent payout methods (e.g., PayPal, cryptocurrency) require verified age 18 or older. We are not liable for payouts sent to account details you provided incorrectly.
• Taxes. You are responsible for any taxes on rewards you receive. We may require tax information and may report payouts to authorities where the law requires (e.g., IRS Form 1099 in the U.S.).

8. Prohibited conduct

You agree not to:

• Create or use more than one account, or use another person's account;
• Use VPNs, proxies, emulators, location-spoofing, or similar tools to misrepresent your identity, device, or location;
• Use bots, scripts, automation, scraping, or any non-human means to access the Service or complete Offers;
• Provide false information, fake completions, or manipulate Offers, surveys, or rewards;
• Engage in self-referral or referral abuse;
• Interfere with, overload, probe, or attempt to bypass the security or integrity of the Service;
• Reverse engineer, copy, or misuse the Service or its content;
• Post or transmit unlawful, hateful, harassing, defamatory, or otherwise objectionable content;
• Use the Service for any unlawful purpose or in violation of these Terms.

9. Fraud, investigation, and enforcement

Fraud and abuse harm the platform and our partners. We may monitor, investigate, and take action on activity we deem suspicious. We may, at our discretion and without prior notice, suspend or terminate accounts, withhold or forfeit Coins and rewards, reverse credits, refuse payouts, and report unlawful activity to authorities or affected partners. Our determination of fraud or abuse, made reasonably and in good faith, is final.

10. Suspension and termination

We may suspend or terminate your access to the Service, with or without cause and with or without notice, including for any violation of these Terms. On termination, your right to use the Service ends and any Coins, rewards, and balances are forfeited, except where prohibited by law. You may close your account at any time; unredeemed Coins are forfeited on closure.

11. Intellectual property

The Service, including its software, design, branding, "EZXP" marks, logos, and content, is owned by us or our licensors and is protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended personal purpose. You receive no other rights.

12. Third-party services

The Service may link to or integrate third-party offers, sites, and services. We do not control and are not responsible for their content, practices, or terms. Your dealings with third parties are solely between you and them.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY OFFER, REWARD, OR PAYOUT WILL BE AVAILABLE OR ACCURATE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME MAY NOT APPLY TO YOU.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EZXP AND ITS OWNERS, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REWARDS, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL CASH VALUE OF REWARDS WE ACTUALLY PAID YOU IN THE 3 MONTHS BEFORE THE CLAIM, OR (B) USD $100. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO SOME MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify and hold harmless EZXP and its owners, officers, employees, and partners from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of any law or third-party right, or content or information you submit.

16. Dispute resolution — arbitration and class-action waiver

Please read this section carefully — it affects how disputes are resolved.

To the extent permitted by law, you and EZXP agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, not in court, except that either party may bring a claim in small-claims court if it qualifies. You and EZXP waive any right to a jury trial and any right to participate in a class, collective, or representative action. Arbitration will be administered by the American Arbitration Association (AAA) under its rules, seated in Clark County, Nevada. This section may not be enforceable in all jurisdictions (for example, certain consumer protections in the EU/UK); where it is not, disputes will proceed under Section 17.

17. Governing law and venue

These Terms are governed by the laws of Nevada, USA, without regard to conflict-of-laws rules. Subject to Section 16, the courts located in Clark County, Nevada will have exclusive jurisdiction, and you consent to that venue. Nothing here removes mandatory consumer protections that apply to you under the law of your country of residence.

18. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time without liability.

19. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what we collect and how we use it.

20. General

• Severability: if any provision is unenforceable, the rest remain in effect.
• No waiver: our failure to enforce a provision is not a waiver.
• Assignment: you may not assign these Terms; we may assign them (e.g., in a merger or sale).
• Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
